INSSA Mentorship Participation Release and Waiver
I (“I”, “me”, “Mentee”, “Mentor”) desire to participate in the Mentoring Program facilitated by the International NGO Safety and Security Association (INSSA) (“INSSA”). As lawful consideration for being permitted by the Organization to participate in the Mentoring Program, I agree to all the terms and conditions set forth in this agreement (“this Agreement”).
1. I acknowledge and affirm that I am voluntarily participating in the Mentoring Program, as a member of INSSA.
2. I understand that the Mentoring Program is designed to support security professionals through personal mentoring for professional development purposes. It is the Mentee’s decision to follow or not follow any advice and support a received from a Mentor and following any advice may create a risk of damage to the reputation, property and staff of the Mentee’s employer. I will assure my employer is aware of and in agreement with this Mentorship.
3. I understand that the sole function of INSSA with regard to the Mentoring Program is to facilitate the matching of Mentors with Mentees for professional development purposes. INSSA will have no responsibility for the conduct of any member in the Mentoring Program, any results or lack of results, or any other matter with respect to Mentoring Program. The full responsibility for capability, appropriateness and chances of success lies with the Mentors and Mentees.
4. I further understand that my completion of this Mentorship in no way guarantees my career prospects, or the safety of the Mentee and the Mentee’s employer’s staff, property and reputation and INSSA is not responsible if the principles, experiences, advice, tools and techniques shared in this Mentorship fail to prevent security incidents in any situation.
5. Accordingly, I assume full responsibility for the consequences of the risks described in items 1, 2 and 3 above. Any insurance coverage to protect against such risks is the responsibility of me or my employer.
6. In consideration of being allowed to participate in this Mentorship, I hereby expressly waive and release (on behalf of myself and my heirs, next of kin, personal representatives, and insurers), INSSA; all Mentors, any organisations a Mentor is employed by or affiliated with; Mentees, any organisations a Mentee is employed by or affiliated with; and any other parties involved in the Mentoring Program, and any employees, directors, board members, agents, affiliates, members, successors, and assigns of such entities from any and all claims, liabilities, losses, or damages now known or hereafter known in any jurisdiction throughout the world arising out of my participation in this Mentoring Program.
7. I further agree to indemnify and hold harmless INSSA, and the other entities and persons identified in item 6 above, from and against any claims, liabilities, losses, actions, judgements, awards, or damages of any kind which may result from my participation in the Mentoring Program.
8. I agree that the information disclosed in the Mentor Application form is accessible to all INSSA members who are active Mentors and/or Mentees in the Mentoring Program and who have access to the Mentoring Database.
9. I agree that this release and indemnification is intended to be as broad and inclusive as permitted by law and that if any portion of it should be held legally invalid, the remaining portions shall continue in full force and effect.
10. This Agreement constitutes the sole and entire agreement of INSSA and me with respect to the Mentoring Program and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Mentoring Program. If any term or provision of this Release is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of INSSA and me and their respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the District of Columbia without giving effect to any choice or conflict of law provision or rule (whether of the District of Columbia or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in courts located in District of Columbia and I hereby consent to the exclusive jurisdiction of such courts.
